How Emerging Fair Housing Issues May Affect LIHTC Properties

Housing

Reasonable accommodation claims continue to skyrocket. Most of the increase is attributable to claims by persons with psychiatric or emotional disabilities, including increasing requests for assistance animals.

NAHB’s Fair Housing: Addressing the Issues Facing LIHTC Properties webinar on Thursday, Oct. 10, at 2-3 p.m. ET, will offer practical guidance on how to identify and address reasonable accommodation requests, including debunking some of the myths that lead managers to believe they can never say “no” to a request.

HUD’s Implementation of the Fair Housing Act’s Disparate Impact Standard was published on Aug. 19, 2019. The proposed rules appear to make it more challenging for plaintiffs, including fair housing groups, to establish disparate impact claims. The webinar will cover how these proposed rules may curtail disparate impact claims, including challenges to criminal background policies.

Participants in this webinar will:

  • Gain an understanding of Fair Housing Act reasonable accommodation, accessibility and disparate impact claims.
  • Understand how the latest guidance, case law and enforcement actions are shaping the fair housing landscape for LIHTC owners and managers.
  • Learn practical tips to evaluate reasonable accommodation requests, mitigate design and construction violations, and implement policies that will not result in disparate impact liability.

Registration is open until 3 p.m. ET (12 p.m. PT) on Wednesday, Oct. 9. For questions about registration, please contact Deborah Krat at EdWebinars@nahb.org.

Course participants can earn one hour of continuing education credits for the following 12 designations: CAPS, CGA, CGB, CGP, CGR, CMP, CSP, GMB, GMR, Master CGP, Master CSP, MIRM.
